Georgia was the only state that distributed parcels of land by lottery. Several thousand lucky individuals received lots distributed during the Gold Lottery of 1832 from an area considered "Cherokee Land." This lottery gave land from the Cherokee Nation to Georgia settlers which sparked the "Trail of Tears". Located in the northeastern part of the state, over 18,500 parcels were distributed by lottery in that year. Each record of this collection contains the individual's name, residence, and county. Additionally, it provides the district and section number of the parcel of land.

Lewis Scalf received 160 acres from the lottery which was surveyed on June 16, 1832 which cost him $18.00, and he received the Grant certificate from the State of Georgia on July 1, 1843. Lewis is believed to have died by 1840. He was not listed on the 1840 Georgia census records and we believe the grant certificate might have been issued to a survivor; however, it is possible he was living with a family member in 1840 and missed on the census records. We have no proof at this time and no other information was found concerning the land grant for Joseph Scalf/Scaff. We believe that Joseph could have been the older male in the home of Lewis Scalf in Habersham County, Georgia in 1830.

In 1835, the Kentucky General Assembly modified the system
for patenting unappropriated land in the Commonwealth of Kentucky. Prospective landowners
purchased orders, also called "Warrants", from the county court
authorizing the county surveyor to survey a tract of unappropriated land for a
patent application. The total acreage could not exceed the amount specified in
each warrant, and the land had to be located within the county issuing the
warrant. More than one warrant could be used for each survey. The survey and a
copy of the authorizing order(s) were then sent to the Register of the Land
Office in Frankfort. Upon approval by the Land Register,
the Attorney General or the Governor signed the grant finalizing the patent. –

Thomas Jefferson Scalf is the grandson of John Scalf, Sr. and Edema Carlisle. At one time Thomas owned several hundred acres of land that he purchased through the County Court Order Series, which is defined above. Thomas purchased three warrants from the Knox County Court, which authorized surveys for the land in question. After receiving the warrants and surveys, the Land Office Division in Frankfort, Kentucky issued patents on the three tracts of land to Thomas.
The first warrant was an 80-acre tract of land, Patent #41676, which was surveyed on May 16, 1868 and granted to Thomas on February 16, 1869. At the present time, we are unable, with any certainty, to identify the relationship of John W. Scaff with the other Scalfs/Scaffs in Pike County, Kentucky. Without a doubt, he is a descendent of Brittany Scalf. It is possible that John is a young boy and this track of land was purchased for him by a parent or uncle. If this is the case, we may be overlooking him. We will continue to research this issue and update the document at the appropriate time.
